The defendant, Sam R. Hochman, was charged with the offense of selling booklets and playing cards containing obscene pictures
in violation of sec. 351.38, Stats., of 1953. Before trial the defendant interposed a motion to suppress the evidence on ground
that it was illegally obtained by means of entrapment on part of the arresting police officer. After a hearing the court by
order denied the motion. Trial was thereafter had to the court without a jury. The defendant was found 'guilty' as charged
and judgment of conviction was entered against him. The appeal is by the defendant from both the order and the judgment. The
