The defendant was tried upon a charge of burglary in the nighttime. At the preliminary examination she was represented by
counsel and she was also represented by counsel at the time she signed a document waiving a trial by jury. She had no counsel
at the time the case was called for trial. She was asked by the court if she wanted an attorney, but she stated that she did
not. The first witness called by the state was one of two men who had pleaded guilty to the burglary in which it was contended
this defendant was a participant. At the close of his testimony, in response to questions by the district attorney, the court
announced to the defendant: 'You can ask any questions you want of this witness.' The defendant replied that she had no questions.
An investigator of the sheriff's department was the second and last witness called by the state. At the Conclusion of his
testimony the court asked the defendant this question: 'Do you wish to make a statement of any kind?' The defendant stated
that she did not.
