Homicide. The defendant, Steve Stortecky, was convicted of the offense of murder in the first degree in a trial before the court and a jury after having entered a plea of not guilty to the information which charged such offense. The action had been transferred by order of the court from Taylor county to Price county upon the application of the defendant for reason that he could not have a fair and impartial trial in Taylor county due to the prejudice of the people. The appeal is from the judgment dated April 21, 1955, entered upon the jurys verdict, adjudging the defendant guilty of murder in the first degree contrary to section 340.02, Stats., and the sentencing of the defendant to a term of life imprisonment in the Wisconsin State Prison at Waupun; and from an order of the court dated April 21, 1955 denying the defendants motion for a new trial.
