The defendant, age 51 years was found guilty by a jury on December 16, 1957 of causing great bodily harm to another human being by conduct evincing a depraved mind, regardless of life, in violation of sec. 940.23, stats., and was acquitted of an aggravated battery under sec. 940.22, stats. The jury recommended leniency and by judgment entered December 20, 1957 the trial court imposed a sentence upon the defendant of an indeterminate term of not more than 2 1/2 years.
